Homefarm values transparency in all our operations and we would like to take this opportunity to share with you our Terms and Conditions of Use and Service.
By accessing or using www.myhomefarm.io or any of its associated blogs or online platforms (“the Website”), owned and operated by Homefarm Pty. Ltd. (2017/082196/07) (“Homefarm”), you agree that you have read, understood and consent to be bound to the terms and conditions contained herein (“Terms”). All rights in and to the content of the Website remain at all times expressly reserved by Homefarm.
Please pay specific attention to the BOLD paragraphs of the Homefarm Terms. These paragraphs limit the risk or liability of Homefarm or a related third-party, constitutes an assumption of risk or liability by you, impose an obligation by you to indemnify Homefarm or is an acknowledgement of any fact by you.
The competition is open to South African Residents above the age of 18, who are in possession of valid identity document, except directors, members, partners, employees, consultants of or any other person who directly or indirectly controls or is controlled by the Promoter or marketing service providers in respect of the competition, or their spouses, life partners, business partners or immediate family members.
You may only enter this competition if you are a lodge, restaurant, cafeteria or commercial kitchen owner, manager or employee residing in South Africa, in the Gauteng, NorthWest, Mpumalanga and Limpopo provinces.
“To enter the competition, entrants are required to complete and submit the form found on the designated web page, between 8 June and 30 July 2023 ONLY.
Entrants may expect to receive confirmation of entry by email.
Entrants may opt to fill in a secondary survey for a greater chance of winning the competition (see qualification criteria)
-Entrants completing the form must be 18 years or older, or legally emancipated with proof thereof.
-Businesses being entered into the competition must use microgreens and other leafy green produce in their menu items.
-Businesses will be required to supply Homefarm with content related to the use of the prize, during the period of the prize installation as requested by Homefarm.
-Businesses will be required to go on record to review the experience of the prize, in video format during the period of prize installation, as requested by Homefarm.
People and businesses recognising any shortfall in themselves, in relation to the qualifying criteria for this competition, should not submit entries.”
“The competition runs from 8 June 2023 to 30 July 2023.
Late and incomplete entries will be disregarded.
It is the sole responsibility of the entrant to ensure that entries are submitted through the indicated advertised channels. The competition organisers are indemnified against any entries considered ‘lost’, ‘delayed’ or ‘damaged’ due to entrants’ misuse of entry material, including instructions and digital platforms and software failure resulting from third party software operations, including the Homefarm website, forms featured therein and automation software which captures and stores competition entries.
Entries are considered valid if and only if the competition organisers receive record of such entries, and entrants are able to produce written proof that the competition organiser has confirmed such entry being received by Homefarm.”
The competition organisers reserve the right to host and promote the competition on platforms of their choice. All prize details, qualification and entry criteria found in these terms and conditions form the full and final terms and conditions of the competition and are subject to change without notice. It is the responsibility of the competition entrant to frequently visit this page during the competition timeline, to stay updated with terms and conditions.
The prize consists of:
Small Homefarm Commercial System, a fully automated soil-based hydroponic system worth over R25 000 (twentythousand Rand), professionally installed and left in place for a period of three calendar months together with all seeds, training and support to grow greens and ensure an operational system. Delivery of pre-planted trays should the winner be located in Gauteng, or delivery of grow media and seeds should the winner be located outside of Gauteng.
Features in a selection of Homefarm’s marketing collateral and campaigns, worth over R5 000.
“The judges’ decision is final and may not be overruled; no correspondence related thereto will be engaged. Homefarm reserves the right to appoint judges.
The top ten (10) entries overall will be eligible for a 20% discount on the outright purchase of any Homefarm Commercial System ordered by 31 July 2023.
Homefarm reserves the right to contact all entrants, especially finalists and winners as deemed necessary by the mechanics of this competition, and to publish winner announcements across owned, controlled, influenced and purchased media channels and assets.
Finalists and winners will be selected by the Homefarm-appointed judging panel by the 8th of July 2023.”
The Promoter will endeavor to contact the prize winner via email,sms and/or direct message on the appropriate social media platform to acquire their contact information. If, however, the winner cannot be reached after 4 (four) attempts have been made to contact them during business hours within a period of 3 (three) working days for any reason whatsoever, the prize will be forfeited and another winner will be selected in accordance with the competition rules.
The prize is not exchangeable for cash and not transferable. The Promoter reserves the right to cancel or amend without notice the terms of this promotion and any prizes issued in the event of a major catastrophe, war, earthquake or any actual or anticipated or alleged breach of any applicable law or regulation or any other circumstance beyond the Promoters’ control.
The Promoter reserves the right to request that images are taken of the prize winner to be used for publicity purposes. Any other videos, images or audio visual content requested and that a prize winner allow their name and likeness to be used by the Promoter in its marketing material in any manner which the promoter deems fit. Should the prize winner consent to the use of their image, name and likeness, no remuneration will be payable to the prize winner, and all materials arising from such use will be the sole property of the Promoter. The winner will have usage rights to material created relevant to the winner.
The Promoter shall have the right to terminate the competition immediately and without notice for any reason beyond its control requiring this. In the event of such termination, all participants agree to waive any rights that they may have in terms of this promotion and acknowledge that they will have no recourse against the Promoter, its agents and staff.
The winner, by having entered into this competition, acknowledges that they have simultaneously waived the right to decline permission to use their name or image in marketing material or participate in any marketing activity relating to the prize announcement and installation.
By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoter and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners. All personal information relating to the Participants will be used solely in accordance with South African consumer and data protection legislation.
Should the Participant have elected to receive marketing communication from the Promoter, the Participant’s contact details will form part of the Promoter’s database and they will receive marketing communication on, including but not limited to, upcoming promotions, competitions and offers. The Participant’s personal information will be shared with Homefarm and their agents to the extent necessary to ensure they receive this communication either via email or SMS, and for prize to be delivered to prize winners. Should a Participant wish to remove their details from this database at any stage, please select the opt-out option made available to you.
Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act.
All publicity and other materials will be the sole property of the Promoter.
The Promoter reserves the right to cancel or amend without notice the terms of this promotion and any prizes issued in the event of a major catastrophe, war, earthquake or any actual or anticipated or alleged breach of any applicable law or regulation or any other circumstance beyond the Promoters’ control.
To the fullest extent permitted by law, by participating, the Participant indemnifies, releases and agrees to hold harmless the Promoter, their associated, holding and subsidiary companies, and its directors, officers, agents, representatives, shareholders, employees, successors and assigns from any and all claims or liability arising from participating in the Competition, any Competition-related activity and/or acceptance, receipt, possession or use/misuse of any prize.
To the extent permitted by law, the Promoter will not be liable in any way whatsoever, for any claims arising from loss, injury, damage or costs, suffered by a Participant in relation to this Competition or the prizes offered, including but not limited to claims relating to defects in the prizes or any losses caused by such defects or losses arising from incorrect or inaccurate information supplied by Participants.
The Promoter will not be liable for any loss suffered as a result of incomplete or incorrect information provided.
South African law shall be applicable and the South African courts shall have exclusive jurisdiction over any proceedings in connection with this promotion.
Participation in the competition constitute acceptance of the competition rules and entrants agree to abide by these Terms and Conditions.
